Meal and Rest Breaks in California

Understanding your meal and rest break rights and when additional pay may apply

Employees who work more than five (5) hours in a workday are generally entitled to a 30-minute uninterrupted, duty-free meal period. Employees who work more than ten (10) hours in a workday are generally entitled to a second 30-minute uninterrupted, duty-free meal period. Meal periods must be recorded accurately, and employees should take all required meal breaks as scheduled.

During a meal period, employees are relieved of all work duties and are free to spend the time as they choose. Employees should not perform any work during a meal period unless they have a lawful, approved on-duty meal period agreement. Employees are also prohibited from working off the clock or altering time records.

If you are unable to take a required meal period, are asked to work through a meal period, or believe your meal period rights have not been provided, notify your Scoot Consultant as soon as possible.

Additional pay may be provided in situations where a required meal period was not made available in accordance with applicable law
